Creator royalties were once heralded as the defining economic innovation of the NFT era — a mechanism that would finally allow digital artists to participate in the long-term appreciation of their work. The premise was straightforward: embed a royalty percentage into a smart contract, and every time the asset changed hands on the secondary market, a portion of the sale price would route automatically back to the original creator. Passive income, enforced by code, with no intermediary required.
That promise has since unraveled in ways that were both predictable and, for many creators, financially devastating. Across the US digital art community and beyond, the royalty infrastructure that underpinned billions of dollars in projected creator earnings has been quietly circumvented — not through a single exploit, but through a gradual accumulation of marketplace incentives, technical loopholes, and buyer behavior that collectively renders enforcement nearly impossible.
The Technical Gap Between Intent and Execution
The core problem lies in a fundamental limitation of how most NFT royalties were originally implemented. On Ethereum and many comparable networks, royalties are not enforced at the protocol level. Instead, they are honored — or ignored — at the discretion of the marketplace facilitating the transaction.
Early platforms like OpenSea made royalty payment a social contract, not a technical requirement. When that standard held, creators received their cut. But as the market matured and competition among platforms intensified, newer entrants began offering zero-royalty or optional-royalty trading as a feature designed to attract volume. Buyers, naturally, gravitated toward platforms where they could acquire assets without paying the additional percentage — sometimes two to ten percent of the sale price — that creators had originally stipulated.
The result was a race to the bottom. Established platforms faced a choice between enforcing royalties and losing market share, or relaxing enforcement and retaining traders. Most chose the latter, at least partially.
Aggregators and the Routing Problem
Marketplace aggregators compounded the issue significantly. Tools that sweep listings across multiple platforms and route transactions through whichever venue offers the lowest total cost have become standard instruments for active traders. When that lowest-cost calculation excludes royalties — because the aggregator is routing through a marketplace that does not enforce them — creators lose their share entirely, with no visibility into the transaction and no recourse.
For high-volume collections, the aggregate effect is substantial. Analysis of several prominent generative art collections suggests that royalty compliance rates on secondary trades have fallen well below fifty percent on some platforms, with the gap widening as trading activity migrates toward aggregator-driven execution. A creator who anticipated earning five percent on every resale may now be receiving that payment on fewer than half of qualifying transactions.
Direct wallet-to-wallet transfers represent an even more complete bypass. When two parties agree on a price and execute the transfer outside any marketplace entirely — using a simple transfer function or a custom escrow arrangement — no royalty mechanism triggers at all. The blockchain records the ownership change, but the creator receives nothing.
The Economic Incentives Are Not Going Away
It would be convenient to frame royalty evasion as a niche behavior confined to sophisticated traders. The reality is more uncomfortable. Even casual buyers have rational economic incentives to minimize acquisition costs. When a platform prominently advertises zero-royalty trading, the framing is not that creators are being harmed — it is that buyers are saving money. The moral dimension of the transaction is obscured by the user interface.
This dynamic is particularly pronounced during bear markets and periods of compressed NFT valuations. When collection floor prices are declining, buyers are already absorbing potential losses on their purchases. The marginal cost of a five percent royalty becomes more psychologically significant, and the appeal of royalty-free platforms increases proportionally.
For creators who built financial projections around secondary market royalties — and many did, particularly those who sold primary editions at relatively modest prices with the expectation of long-term resale participation — the erosion has had real consequences. Some have publicly disclosed that royalty income has declined by sixty to eighty percent compared to peak periods, despite continued secondary trading activity in their collections.
Protocol-Level Enforcement: The 2025 Landscape
The most technically robust solution to the royalty problem involves moving enforcement from the marketplace layer to the protocol layer — making it impossible, rather than merely impolite, to transfer an NFT without triggering the associated royalty payment. Several approaches have gained traction in 2025.
Operator filter registries, pioneered in earlier iterations by major platforms, attempted to blacklist non-compliant marketplaces from interacting with specific contracts. The approach had partial success but proved susceptible to workarounds and created friction for legitimate use cases.
More promising are programmable transfer restrictions embedded directly in token contracts. Under this model, a transfer can only execute if it passes through an approved payment splitter that automatically routes the royalty amount to the creator's wallet before completing the ownership change. Platforms including certain Ethereum Layer 2 networks and newer NFT infrastructure providers have begun supporting this architecture natively.
The tradeoff is liquidity fragmentation. If a collection's tokens can only trade on royalty-compliant venues, the addressable market for those assets narrows. Collectors may discount the asset's value accordingly, anticipating reduced exit options. Creators must weigh guaranteed royalty capture against potential suppression of secondary market activity and price discovery.
On-Chain Standards and Collective Action
A parallel development involves industry-wide standards that attempt to codify royalty expectations at the metadata and contract interface level. Proposals circulating within the Ethereum developer community would establish a common interface that compliant marketplaces can query, allowing creators to specify royalty terms in a standardized format while enabling platforms to signal their compliance status transparently.
The effectiveness of such standards ultimately depends on adoption, which returns the problem to the realm of market incentives. Standards work when following them is either legally required or commercially advantageous. Neither condition is firmly established in the current US regulatory environment, where NFT-specific legislation remains limited and platform competition continues to reward volume over creator protection.
Some creator communities have responded by organizing collective action — publicly identifying non-compliant platforms, coordinating primary sale launches exclusively with royalty-enforcing partners, and building buyer education into their community communications. These efforts have had modest success in preserving royalty compliance within specific collector bases, but they do not scale across the broader market.
What Traders and Collectors Should Understand
For participants on the buy side of secondary NFT markets, the royalty conversation carries implications beyond ethics. Collections with strong creator communities and active royalty enforcement tend to exhibit more sustained floor price support, because creators have ongoing financial incentives to promote, develop, and maintain their projects. Collections where royalties have collapsed often see corresponding declines in creator engagement — and, over time, in collector interest.
The choice of where to execute a secondary purchase is, in this sense, a statement about the kind of market infrastructure a trader wants to support. Platforms that enforce royalties may carry marginally higher transaction costs in the short term. The long-term question is whether those costs are offset by the value of operating in a market where creator incentives remain intact.
As on-chain commerce matures, the royalty problem is unlikely to resolve itself through goodwill alone. The solutions that will endure are those embedded in the architecture of the transaction itself — code that makes the right outcome the only outcome, rather than merely the preferred one.
